ARE JANUARY AND FEBRUARY THE MOST POPULAR DIVORCE MONTHS?


Family lawyers tend to refer to January and February as the “National divorce months” due to the high number of people filing for divorce after the new year. Why is this and is there any truth to this assumption?

Statistically, family law firms have reported increased divorce filings in the months of January and February as compared to the other months of the year. Why do people typically wait until after the holidays to file for divorce? There are several reasons for this:

1. The holidays can be used as a mile marker. Oftentimes, the decision to end a marriage is predetermined. Many people choose to wait until the timing is right, especially if they have children or want to figure out their financial situation beforehand. For some, this might mean waiting until after the holidays to break the news to their spouse, family, or loved ones. Some might consult with a lawyer to plan the impending divorce and gather documents.

2. The holidays are stressful. Seasonal obligations and financial stress can push someone to their breaking point and lead them to reevaluate their life choices. The holidays are a time of reflection for many people and reassessing their future.

3. The New Year offers people a fresh start. Ringing in the New Year can also offer people a sense of finality and closure, leading them to make these changes during what they already perceive to be a natural transition period with new beginnings around the corner.

4. Couples are preparing for the next tax year. Timing a divorce at the beginning of the calendar year can help couples prepare for taxes ahead of time. It may increase the chances of a soon-to-be divorcee qualifying to file as head of household for the following tax year.
